Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and SXLHUB governing your access to and use of our platform, including all content, functionality, mods, maps, gear, services, and features offered through our website. By creating an account, downloading mods, or otherwise engaging with our platform, you acknowledge that you have read, understood, and agree to be bound by these terms.

We reserve the right to modify these Terms of Service at any time. Changes will become effective immediately upon posting to the platform. Your continued use after such modifications constitutes acceptance of the updated terms. It is your responsibility to review these terms periodically to stay informed of any changes.

Eligibility and Account Registration

Age Requirements

You must be at least 13 years of age to use SXLHUB. If you are between 13 and 18 years old, you may only use our platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms of Service. By using our platform, you represent and warrant that you meet these age requirements.

Account Creation

To access certain features of SXLHUB, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

You may not create multiple accounts, share your account with others, or transfer your account to another person without our express written consent. We reserve the right to suspend or terminate accounts that violate these provisions or that we determine, in our sole discretion, pose a security risk or harm to the community.

Acceptable Use Policy

Your use of SXLHUB is subject to the following acceptable use guidelines. You agree not to:

• Upload, distribute, or share mods that contain malicious code, viruses, malware, or any harmful components
• Engage in any activity that interferes with or disrupts the platform or servers connected to the platform
• Use the platform for any illegal purpose or in violation of any local, state, national, or international law
• Harass, threaten, defame, or otherwise harm other users or community members
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Collect or store personal data about other users without their express permission
• Attempt to gain unauthorized access to any portion of the platform, other user accounts, or connected systems
• Use automated systems, bots, or scripts to access the platform or extract data without authorization
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the platform for commercial purposes without our written consent
• Remove, circumvent, disable, or otherwise interfere with security features or features that prevent unauthorized use
• Post or distribute content that infringes on intellectual property rights, including copyrights, trademarks, or patents
• Share content that is obscene, pornographic, discriminatory, hateful, or promotes violence

Violation of these acceptable use provisions may result in immediate termination of your account and legal action if appropriate.

Intellectual Property Rights

SXLHUB Intellectual Property

All content on SXLHUB, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof, is the property of SXLHUB or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The SXLHUB name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SXLHUB or its affiliates. You may not use such marks without our prior written permission. Other names, logos, and brands are the property of their respective owners.

User-Generated Content

When you upload, submit, or otherwise make available any mods, maps, gear, comments, reviews, or other content to SXLHUB, you retain ownership of your intellectual property rights. However, you grant SXLHUB a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with operating and promoting the platform.

You represent and warrant that you have all necessary rights to grant the licenses described above and that your content does not infringe or violate any third-party rights. You are solely responsible for your content and the consequences of posting or publishing it.

Mod Licensing

Mods available through SXLHUB are provided for use with Skater XL. Unless otherwise specified, mods are offered under the terms determined by their respective creators. By downloading and using mods, you agree to comply with any licensing terms associated with that specific mod. SXLHUB is not responsible for enforcing third-party licenses but reserves the right to remove content that violates intellectual property rights.

Disclaimers and Limitation of Liability

Service Availability

SXLHUB is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no warranties regarding the accuracy, reliability, or completeness of any content on the platform.

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time, including the availability of any feature, database, or content, without notice or liability.

Third-Party Content

SXLHUB hosts user-generated content and mods created by third-party developers. We do not endorse, guarantee, or assume responsibility for any third-party content. You acknowledge that we are not liable for any loss or damage resulting from your use of or reliance on such content.

Mods may affect the performance or stability of Skater XL or your device. You download and install mods at your own risk. SXLHUB is not responsible for any damage to your device, loss of data, or other harm resulting from mod installation or use.

Limitation of Liability

To the maximum extent permitted by law, SXLHUB and its officers, directors, employees, agents, licensors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the platform.

In no event shall SXLHUB's total liability to you for all claims arising out of or related to your use of the platform exceed the amount paid by you, if any, to SXLHUB during the six months prior to the claim, or one hundred dollars, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless SXLHUB, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms of Service or your use of the platform, including but not limited to your user content, any use of the platform's content, services, and products other than as expressly authorized in these Terms of Service.

Termination

We reserve the right to suspend or terminate your account and access to SXLHUB at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to, violation of these Terms of Service, fraudulent activity, abusive behavior toward other users, or any conduct that we determine, in our sole discretion, is harmful to the platform or community.

Upon termination, your right to use the platform will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion feature if available. Upon termination, you will lose access to your account and any content associated with it.

Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the United States, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of or related to these Terms of Service or the platform shall be instituted exclusively in the federal or state courts located in the appropriate jurisdiction. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of SXLHUB, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved through negotiation within thirty days, either party may pursue resolution through binding arbitration or litigation as permitted by law.

Third-Party Links and Services

SXLHUB may contain links to third-party websites, services, or resources that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that SXLHUB shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Miscellaneous Provisions

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by us on the platform, constitute the entire agreement between you and SXLHUB concerning your use of the platform and supersede all prior agreements and understandings.

Severability

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Waiver

No waiver by SXLHUB of any term or condition set forth in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms of Service or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms of Service at any time without notice or consent.
